REPORTS FROM SPECIAL COMMITTEES AUTHORIZED BY THE FACULTY COUNCIL.

D 8563 Revision of the Handbook of Operating Procedures, Chapter 1, Section V. Clarifying the Voting Rights of Faculty in Colleges, Schools, and Departments. Posted on the Faculty Council website on February 8, 2011. The secretary has classified this as general legislation. The legislation was approved by the Faculty Council on February 14, 2011, and transmitted to the President on February 15, 2011. On February 22, 2011, the President’s office requested written recommendation regarding the legislation from Provost Leslie and Vice President Ohlendorf. On March 2, 2011, Provost Leslie recommended approval of the revision. On October 20, 2011, the secretary received an update from the president's office concerning D 8512-8513, which is tied to this one, indicating that the current wording of the proposal raises questions of intent and interpretation and will need to be addressed by the Faculty Rules and Governance Committee before action will be taken by the president. Final approval resides with UT System.

D 8997 Revisions Proposed by the Graduate Assembly to Recent Amendments to the In Absentia Policy Passed by the Faculty Council in May 2011. Posted on the Faculty Council website on September 16, 2011. The secretary has classified this proposal as general legislation. The Faculty Council approved the revision on a no-protest basis on September 26, 2011. Transmitted to the President on September 27, 2011. On October 4, 2011, the President’s Office requested written recommendation regarding the legislation from Provost Leslie and Vice President Ohlendorf. On March 19, 2012, Provost Leslie recommended approval of the proposal. Final approval resides with UT System.

D 9686-9688 University of Texas at Austin Guidelines for Implementing the Rules and Regulations of the Board of Regents’ Rule 31102: Evaluation of Tenured Faculty. Posted on the Faculty Council website on April 23, 2013. The secretary classified this proposal as general legislation. The guidelines were approved by the Faculty Council on April 23, 2012, and were transmitted to the president on May 3, 2012. On  May 14, 2012, the president’s office requested written recommendation regarding the legislation from Executive Vice President and Provost Steven Leslie and Vice President Patricia Ohlendorf. On May 29, 2012, Provost Leslie recommended approval. Final approval resides with the president.

D 9987-10000 Report of the Committee to Nominate Faculty Members for Appointment to the University of Texas Police Oversight Committee. Posted on the Faculty Council website on October 10, 2012. On May 10, 2010, the Faculty Council approved legislation (D 8009-8012) proposing changes to the Threatened Faculty Retrenchment policy in the Handbook of Operating Procedures 2-2230 (then HOP 3.16). However, the legislation was disapproved by the president and returned to the Faculty Council. The Faculty Council approved a second proposal (D 8624-8628) on April 11, 2011, which was also returned by the president. Further discussion with President Powers and Provost Leslie regarding the procedures for appeal produced further revisions resulting in D 8936-8939, which was approved by the Faculty Council on September 19, 2011, and by the General Faculty on October 5, 2011. On February 24, 2012. President Powers transmitted the legislation to UT System recommending approval. On June 20, 2012, UT System’s Vice Chancellor and Deputy General Counsel Dan Sharphorn returned the legislation. The FCEC, current and past chairs of the Faculty Rules and Governance Committee, the provost, and the vice president of legal affairs worked closely with Mr. Sharphorn to address his concerns. On October 1, 2012, the FCEC, Provost Steve Leslie, and Vice President Patricia Ohlendorf determined that the subsequent revisions to the Threatened Faculty Retrenchment policy do not need approval of the Faculty Council, since the changes are non-substantive and are in keeping with the spirit of D 8936-8939. On November 7, 2012, the policy was retransmitted to the president with revisions to the Policy Statement on D 9992. Upon institutional approval, the Office of the President will transmit the revised policy to UT System for final approval.

D 10042-10087 Final Report of the Ad Hoc Joint Committee of the Graduate Assembly and Faculty Council on Graduate Student Fellowships. Posted on the Faculty Council website on November 7, 2012. The secretary classified this as legislation of general interest. The Faculty Council amended and approved the report on November 19, 2012. Transmitted to President Powers on November 20, 2012. On November 29, 2012, President Powers acknowledged receipt of the report and is holding it pending its reconsideration by the Graduate Assembly. On February 14, 2013, Diane Schallert, secretary of Graduate Assembly, notified the president of the reports approval by the Graduate Assembly. On April 23, 2013, the president’s office requested written recommendation regarding the legislation from Provost Steve Leslie, Vice President Patricia Ohlendorf, and Vice Provost and Dean Judith Langlois. Final approval resides with the president. On May 13, 2013, Provost Leslie recommended approval. Final approval resides with the president.

D 10167-10171 Creation of a New Student Honor Code and Renaming the Current Honor Code to the University Code of Conduct. Posted on the Faculty Council website on January 14, 2013. The secretary has classified this report as being of general interest. On January 7, 2013, in consultation with the president, the Faculty Council Executive Committee discussed the Senate of College Council’s resolution SR 1203, which supports the creation of a Student Honor Code. It was determined that the current Honor Code, which applies to all students, faculty, and staff, should be renamed “University Code of Conduct,” and from the resolution submitted by the Senate of College Councils, a new Student Honor Code should be created. Chair Martha Hilley presented the report to the Faculty Council on January 28, 2013. No action was required of the Faculty Council. On February 6, 2013, President Powers formally adopted the new Student Honor Code and the University Code of Conduct.

D 10195 Resolution Reaffirming the Ban of Firearms on Campus.Posted on the Faculty Council website on February 7, 2013. The secretary has classified this resolution as legislation of general interest. The Faculty Council endorsed the resolution on February 18, 2013. President Powers was notified of the endorsement in a letter dated February 19, 2013. On April 25, 2013, President Powers acknowledged receipt and his support of the resolution, thanking the Council for its action on this very important topic. Final approval resides with the Faculty Council with formal notification to the president. No further action required.

D 10223-10224 Report of the Committee to Nominate Faculty Members for Appointment to the Intercollegiate Athletics Councils for Men and for Women, and to the University Co-op Board of Directors. Posted on the Faculty Council website on March 7, 2013. The Faculty Council endorsed the report on March 18, 2013. On March 19, 2013, The Office of the General Faculty sent a letter to President Powers requesting an appointment to the University Co-op Board of Directors. On March 20, 2013, the office requested appointments to the Intercollegiate Athletics Councils for Men and for Women. On April 1, 2013, President Powers appointed Professor Robert Wilson (public affairs) to serve on the University Co-op Board of Directors for a four-year term beginning September 1, 2013, and ending August 31, 2017. On April 15, 2013, President Powers notified the secretary that Professor Lori Holleran (associate professor, associate professor, social work) had been appointed to serve on the Intercollegiate Athletics Council for Women, and that Professor Louis Harrison (curriculum and instruction) had been appointed to the Intercollegiate Athletics Council for Men; both faculty members were appointed to serve a four-year term beginning September 1, 2013, and lasting through August 31, 2017.

Report of the Committee to Nominate Faculty Members for Appointment to the University of Texas Police Oversight Committee. Posted on the Faculty Council website on March 7, 2013. The secretary classified the report as general legislation. The Faculty Council approved the nominee panel on March 18, 2013. On March 27, 2013, The Office of the General Faculty sent a letter to President Powers requesting an appointment to the UT Police Oversight Committee. On March 27, 2013, President Powers appointed Penelope Davis (associate professor, art and art history).

D 10226 Report of the Committee to Nominate Voting Faculty Members to the Undergraduate Studies Advisory Committee. Posted on the Faculty Council website on March 7, 2013. The secretary classified the report as general legislation. On March 18, 2013, the Faculty Council elected William Beckner (professor, mathematics) and Coleman Hutchison (associate professor, English) to the Undergraduate Studies Advisory committee to serve three-year terms of service beginning September 1, 2013, and ending August 31, 2016.

D 10326-10327 Resolution Regarding UTS 180: "Conflicts of Interest, Conflicts of Commitment, and Outside Activities" Policy. Posted on the Faculty Council website on April 23, 2013. The secretary classified this resolution as general legislation. The Faculty Council endorsed the resolution on  May 6, 2013. The resolution was transmitted to the president with a request to forward it to UT System. On May 21, 2013, President Powers transmitted the report to UT System on behalf of the Faculty Council. Final approval resides with the Faculty Council with formal notification to the president.

D 10356-10357 Report of the Committee to Nominate Faculty Council Officers for 2013-2014. Posted on the Faculty Council website on May 1, 2013. The secretary classified this report as general legislation. At its meeting on May 6, 2013, the Faculty Council elected the following officers to serve on the Faculty Council Executive Committee for 2013-14: William Beckner, chair elect (professor, mathematics), Professors Brian L. Evans (professor, electrical and computer engineering), Elizabeth T. Gershoff (associate professor, human development and family sciences, and Susan R. Klein (professor, law). Other members of the 2013-14 Faculty Council Executive Committee are Hillary Hart, chair (distinguished sr. lecturer civil, architectural, and environmental engineering), Martha F. Hilley, past chair (professor, music), Dean P. Neikirk (secretary professor, electrical and computer engineering), and L. Michael White, chair, Graduate Assembly (professor, religious studies and classics).

The Secretary has classified this resolution as general legislation. The Faculty Council endorsed the resolution at its May 6 meeting. The report was transmitted to the president with a request to forward it to UT System. On May 21, 2013, President Powers transmitted the report to UT System on behalf of the Faculty Council. No further action was required.
