D 7825-7844

Proposed revisions of the Handbook of Operating Procedures, Sections 3.18 and 4.03 from the Faculty Grievance Committee. Posted on the Faculty Council website on February 9, 2010, and classified as general legislation. Approved by the Faculty Council on February 15, 2010. Transmitted to the president on February 16, 2010. On March 22, 2010, the president's office requested written recommendations regarding the legislation from Provost Leslie and Vice President Ohlendorf. Upon the recommendations from Provost Leslie and Vice President Ohlendorf, the proposals were approved by the president and transmitted to the executive vice chancellor for academic affairs on April 23, 2010.

D 8456-8458 Proposed Revisions to the Departmental Budget Council Constitution and Authority in the Handbook of Operating Procedures. Posted on the Faculty Council website on November 3, 2010. The secretary has classified this as general legislation. It was approved by the Faculty Council on November 15, 2010, and transmitted to the president on November 16, 2010. On November 22, 2010, President Powers asked Dr. Steve Leslie, Mr. Kevin Hegarty, and Ms. Patricia Ohlendorf for written recommendation regarding the legislation. On December 7, 2010, Provost Leslie recommended approval of the legislation. Final approval resides with the UT System.

D 8512-8513 Proposed Changes to the Voting Rights of the General Faculty in the Handbook of Operating Procedures. Posted on the Faculty Council website on January 10, 2011. The secretary has classified this as major legislation. Approved by the Faculty Council on January 24, 2011, and by the voting members of the General Faculty on February 7, 2011. Transmitted to the president on February 8, 2011. On February 10, 2011, President Powers requested written recommendation regarding the legislation from Dr. Steve Leslie and Mrs. Patricia Ohlendorf. On March 8, 2011, Provost Leslie recommended approval of the legislation. On October 20, 2011, the secretary received an update from the President's office indicating that the current wording of the proposal raises questions of intent and interpretation, which will need to be answered by the Faculty Rules and Governance Committee before action will be taken by the president. Final approval of this legislation resides with the UT System.

D 8664 Proposed Changes from the Committee on Committees to Increase General Faculty Standing Committee Terms of Service to Three Years. Posted on the Faculty Council website on May 4, 2011. The secretary has classified this item as general legislation. On May 9, 2011, the Faculty Council approved the proposed changes. On May 10, 2011, the legislation was transmitted to the president. On May 16, 2011, the president’s office requested written recommendations regarding the legislation from Dr. Steven Leslie and Ms. Patricia Ohlendorf. On May 31, 2011, Provost Leslie recommended approval of the proposal. On August 22, 2012, President Powers transmitted the legislation with the implementation plan to UT System recommending approval. On September 11, 2012, final approval was received from UT System.

D 8665 Proposal to Clarify Rules Relating to the Elections of Vice Chairs and Chairs Elect of General Faculty Standing Committees. Posted on the Faculty Council website on May 4, 2011. The secretary has classified this item as general legislation. On May 9, 2011, the Faculty Council approved the proposal. On May 10, 2011, the legislation was transmitted to the president. Final approval resides with UT System.

D 9505-9509 Proposed Revisions to the Language in the Handbook of Operating Procedures and the Policy Memoranda Regarding No-Protest Procedure. Posted on the Faculty Council website on February 17, 2012. The secretary has classified this proposal as legislation of general interest to more than one college or school. On February 29, 2012, the Faculty Council approved the proposal on a no-protest basis and transmitted it to the president on March 1, 2012. On March 6, 2012, the president’s office requested written recommendation regarding the legislation from Provost Leslie and Vice President Ohlendorf. On March 21, 2012, Provost Leslie recommended approval of the proposal. Final approval resides with UT System.

D 9678-9685 Proposed Changes to the Student Academic Employees Policies 12.C.3 and 12.C.4 in the Handbook of Operating Procedures that Affect Undergraduates. Posted on the Faculty Council website on April 30, 2012. The secretary has classified this proposal as legislation of general interest to more than one college or school. On May 7, 2012, the Faculty Council approved the proposal on a no-protest basis. On May 8, 2012, it was transmitted to the provost on behalf of the president. On June 26, 2012, Vice Provost Gretchen Ritter transmitted the legislation to UT System recommending approval. Final approval resides with UT System.

D 9950a-9956 Proposed Revisions to the Policy Affecting Undergraduates in the Handbook of Operating Procedures 9-2030, Graduate and Undergraduate Research Assistants. Posted on the Faculty Council website on September 20, 2012. The secretary has classified this proposal as legislation of general interest to more than one college or school. On behalf of the Responsibilities, Rights, and Welfare of Graduate Student Academic Employees Committee (C-12 committee), Professor Andrea Gore (pharmacy) submitted the proposal recommending changes that affect undergraduates in the Handbook of Operating Procedures 9-2030, Graduate and Undergraduate Research Assistants. The revisions are in keeping with the spirit of the original proposal D 9678-9685 and were endorsed by the Faculty Council Executive Committee on behalf of the Faculty Council on July 30, 2012. This proposal replaces the previous legislation (D 9678-9685), which was approved by the Faculty Council on a no-protest basis on May 7, 2012. On October 10, 2012, the provost’s office transmitted the legislation to UT System recommending approval. On October 12, 2012, the University Policy Office transmitted the legislation to the vice chancellor and general counsel. On February 25, 2013, UT System granted final approval subject to conditions raised by OGC Attorney Priscilla Lozano during her review. The University Policy Office confirmed with Amy Greenspan (student employment advisor, Human Resource Services) and Vice Provost Gretchen Ritter that the conditions have or will be met. The policy has subsequently been updated and published on the Handbook of Operating Procedures (9-2030) website with the edits recommended by Ms. Lozano.

The secretary has classified this proposal as legislation of general legislation. On October 11, 2012, the Faculty Council approved the legislation on a no-protest basis. On October 16, 2012, the proposal was transmitted to the president. On October 22, 2012, President Powers transmitted the legislation to UT System recommending approval. On October 31, 2012, UT System granted final approval.

D 9982-9986 Proposed Change in the Admissions and Registration Committee Student Membership, a General Faculty Standing Committee in the Handbook of Operating Procedures 2-1060-PM. ¬†Posted on the Faculty Council website on October 1, 2012. The secretary has classified this proposal as legislation of general legislation. On October 22, 2012, the Faculty Council approved the legislation on a no-protest basis, and was transmitted to the president on October 23 2012. On October 24, 2012, the president’s office requested recommendations from Dr. Steven Leslie and Dr. Gage Paine. On December 20, 2012, Dr. Paine recommended approval with notification to UT System. On December 20, 2012, President Powers transmitted the proposal to UT System recommending approval. On January 29, 2013, UT System granted final approval.

D 9987-10000 Non-Substantive Revisions to the Threatened Faculty Retrenchment Legislation D 8936-8939. Posted on the Faculty Council website on October 10, 2012. On May 10, 2010, the Faculty Council approved legislation (D 8009-8012) proposing changes to the Threatened Faculty Retrenchment policy in the Handbook of Operating Procedures 2-2230 (then HOP 3.16). However, the legislation was disapproved by the president and returned to the Faculty Council. The Faculty Council approved a second proposal (D 8624-8628) on April 11, 2011, which was also returned by the president. Further discussion with President Powers and Provost Leslie regarding the procedures for appeal produced further revisions resulting in D 8936-8939, which was approved by the Faculty Council on September 19, 2011, and by the General Faculty on October 5, 2011. On February 24, 2012. President Powers transmitted the legislation to UT System recommending approval. On June 20, 2012, UT System’s Vice Chancellor and Deputy General Counsel Dan Sharphorn returned the legislation. The FCEC, current and past chairs of the Faculty Rules and Governance Committee, the provost, and the vice president of legal affairs worked closely with Mr. Sharphorn to address his concerns. On October 1, 2012, the FCEC, Provost Steve Leslie, and Vice President Patricia Ohlendorf determined that the subsequent revisions to the Threatened Faculty Retrenchment policy do not need approval of the Faculty Council, since the changes are non-substantive and are in keeping with the spirit of D 8936-8939. On November 7, 2012, the policy was retransmitted to the president with revisions to the Policy Statement on D 9992. Upon institutional approval, the Office of the President will transmit the revised policy to UT System for final approval.

D 10136-10138 Proposed Changes to the Function of the Faculty Welfare Committee, a Standing Committee of the General Faculty in the Handbook of Operating Procedures 2-1050-PM. Posted on the Faculty Council’s website on November 29, 2012. The secretary has classified this as general legislation. The Faculty Council approved the proposal on December 10, 2012, which was subsequently transmitted to the president on December 13 2012. On December 17, 2012, the president’s office requested recommendations from Dr. Steven Leslie and Dr. Patricia Ohlendorf. On January 7, 2013, Vice President Ohlendorf recommended approval. On January 23, 2013, Provost Leslie recommended approval. April 22, 2013, President Powers transmitted the legislation to UT System recommending approval. On May 8, 2013, UT System granted final approval.

D 10139-10147 Fall Break Proposal from the University Academic Calendar Committee. Posted on the Faculty Council’s website on November 29, 2012. The secretary classified this legislation as being of major interest to the University faculty at-large. The proposal was discussed by the Faculty Council on December 10, 2012. On January 28, 2013, the Faculty Council approved the proposal. Having been classified as major legislation, it was, according to the by-laws of the Council, submitted to the voting members of the General Faculty on a no-protest basis. The secretary received sixty-one formal protests by March 8, 2013, therefore, a special meeting of the General Faculty was scheduled for March 25, at 3:15 in the Hogg Memorial Auditorium (changed from the SAC 1.402). At that meeting, fifty-eight voting members of the General Faculty voted against the proposal, and twenty-seven members voted in favor. The proposal was defeated; no further action can be taken. For reference, the notice of no-protest procedures can be found on D 10222, and the meeting notice can be found on D 10240-10273b.

D 10188-10192 Proposal to Align Affiliated Studies Credit with Reciprocal Exchange Credit so that All UT-Approved Study Abroad Programs Have the Same Academic Characteristics. Posted on the Faculty Council website on February 7, 2013. The secretary has classified this proposal as legislation of general interest. The Faculty Council approved the proposal on February 18, 2013. The proposal was transmitted to the president on February 19, 2013. On April 19, 2013, the president’s office requested written recommendation regarding the legislation from Provost Steve Leslie and Vice President Patricia Ohlendorf. On April 25 ,2013, Provost Leslie recommended approval. Final approval resides with UT System.
