Frequently Asked WCI Questions...What does an employee need to do if injured while on the job?If you are injured while performing work on behalf of your employer or if you acquire an occupational disease as a direct result of your employment, you should immediately inform your supervisor of the injury or disease. In reporting your injury or disease, you must provide your supervisor with the following information:
Who will be handling my workers' compensation claim?If you file a claim for a work related injury, your claim file will be managed by a WCI claim's adjuster at the UT System Workers' Compensation Insurance Office.
How do I get medical treatment?If you require medical treatment for a work related injury, you should immediately choose one treating doctor to coordinate your care. Tell your treating doctor that any bills for your work related injury should be sent directly to:
Payment for medical services will be delayed if your doctor does not send medical bills to the address listed above. Bills for services unrelated to a reported on-the-job injury should be sent to your regular health insurer or should be paid by you. Except in an emergency, if you receive medical care for a work related injury which is not by or at the direction of your treating doctor, you will become responsible for payment of any charges associated with that care. If it becomes necessary to change treating doctors, you must complete an Employee's Request to Change Treating Doctors form (DWC-53) and get written approval from the Texas Department of Insurance, Division of Workers' Compensation before making the change. What are my responsibilities to my employer if I am unable to work because of an on-the-job injury?If you must lose time from work due to a work related injury, your supervisor or your employer's workers' compensation representative should receive a written note from your treating doctor indicating you are unable to work. You are expected to continue communicating with your employer throughout any period of disability unless you are physically unable to do so. If you choose to miss work on your own without your treating doctor's order, your lost time, for purposes of calculating income benefits, will be disputed. You are expected to return to work as soon as you are physically able. If you are released to return to work by your doctor with restrictions, please work with your employer to comply with any restrictions placed on you. Your employer may have other specific rules for you to follow while missing time from work. Please communicate with your supervisor to make sure that you are complying with any other policies. What happens if my doctor releases me back to work with restrictions?Your doctor will give you a Work Status Report (TDI-73) following each office visit. This form should be given to your supervisor. Your department will attempt to find temporary modified-duty work for you that complies with your restrictions in accordance with the university's Return to Work Program (HOP 7.E.3). What if I file a claim for an injury that did not occur at work?Filing a workers' compensation claim for an injury that did not occur while performing work on behalf of your employer is a serious offense. It is a violation punishable by a penalty up to $10,000.00 to knowingly or intentionally do one of the following in an attempt to obtain workers' compensation benefits for yourself or for another person:
In addition to being an administrative violation, intentional commission of any of the above acts in an attempt to obtain benefits may also result in criminal charges (Class A Misdemeanor up to Second Degree Felony). Do I have to complete any forms to make a claim for benefits?Yes. If you have lost time from work due to a work related injury, you should receive a Notice of Injury or Occupational Disease and Claim for Compensation (DWC-41) form from the Texas Department of Insurance, along with instructions for completing the form. The DWC-41 form should be completed as soon as possible and returned to the Texas Department of Insurance.
