Is there a difference between notice and prior notice? To my ear, notice includes the idea of prior. For example, when we say that the basic requirements of fairness are notice and an opportunity to be heard, we mean that you have to receive notice of a proceeding in which you have an interest before the proceeding takes place.
Some write in their contract drafts that thus-and-so cannot be done "without prior written notice." I say "written notice" captures the full idea, and "prior" is redundant. What do you think?

It is possible, though usually quite unpleasant, to receive notice of an action at the time of the action. It has happened to me. Not everyone understands "the basic requirements of fairness".
Sometimes I have used the words "prior written notice" quite deliberately in contracts. However, if the word "prior" is necessary, then it is probably necessary to specify how prior. One second? One month? My appointment card from my dentist request "prior notice of 24 hours" for a cancellation.
In many cases "written notice" is sufficient.
"Prior notice" prompts the question, Prior to what? Suppose I hunt on X's land and X then states, "I gave him notice to stay off my land."
It isn't clear when he gave notice. It might have been before, during, or after my visit.
But if he said, "I gave him prior notice to stay off my land," that implies that he gave me notice before I went on his land. I suppose that could be a significant point in a legal dispute. Context is King.
"Notice" infers advance warning; i.e., " I reviewed notice that my bar dues were late." To say "I received prior written notice that my bar dues were late" seems redundant and just doesn't sound correct.
If the time when notice is given is relevant, then just say so; i.e., "Two weeks ago I received notice that my bar dues were late."
