Abstract:
Responding to perceived inefficiencies in the judicial
administration of probate justice, in 1973 the Texas legislature
eliminated the district court’s appellate jurisdiction over
probate matters. The county courts retained original probate
jurisdiction. However, the legislature’s failure to amend other
statutes dealing with probate review created great uncertainty
with respect to the future role of the district courts. This
comment considers the scope of these changes and addresses the
question of further statutory revision.
