Jonathan E. Silbert, Reviewing John A. Robertson’s Rough
Justice: Perspectives on Lower Criminal Courts, 53 TEXAS L.
REV. 197 (1974).
Abstract:
Rough Justice is an anthology of essays and excerpts on a
variety of aspects of lower criminal court justice. The book is
divided into six parts, presenting the lower courts from the
following perspectives: historical, sociological, political,
narrative, attempted alternative approaches, and reformist.
While Mr. Silbert finds that the book is flawed in its failure
to examine the impact of overcriminalization (e.g., “victimless”
crimes) on the lower criminal courts, he applauds Professor
Robertson for publishing a book whose subject, the lower
criminal courts, deal with the vast majority of criminal cases
in the U.S., but are invariably overlooked in legal education.
