Abstract:
Public financial assistance to individuals victimized by poverty
has become a salient feature of American society. The Social
Security Act came about due to the widespread economic hardships
precipitated by the Depression. One of the four categorical
programs established by the act was the Aid to Families with
Dependent Children (AFDC) that became the largest and most
expansive of the programs. Conflicting state and federal
interests in the context of cooperative federalism has marred
the determination of eligibility requirements for the program.
This note focuses on the recurring problem of the effect that a
stepparent’s presence in the home has upon AFDC eligibility.
