Abstract:
For at least twenty years, reform of the National Labor
Relations Act (NLRA) to expedite resolution of unfair labor
practice charges has been a frequent topic of congressional and
public concern. The Labor Reform Act of 1977 represents the most
recent expression of this concern, specifically, improving NLRB
processes and eliminating the unnecessary delays. Nolan and Lehr
view these representations of the Labor Reform Act as not being
accurate. This article examines the Board’s current unfair labor
practice procedures to determine the cause of observed delay,
analyzes legislative proposals in light of these causes, and
suggests alternative methods of reducing delays in processing
unfair labor practice cases.
