Abstract:
For a national economy dependent upon adequate supplies of energy, the consequences of a substantial shortage are necessarily serious and potentially disastrous. Congress has enacted several acts to deal with energy utilization, but the Federal Power Commission (FPC), and it’s successor, the Federal Energy Regulatory Commision (FERC), developed the curtailment polices and rules to regulate the distribution of natural gas to minimize the immediate effects of a gas shortage. In his note, Thomas Anson argues that these policies and rules do not meet the needs of curtailed users as efficiently and equitably as would the addition of a secondary market, or “white market”, that permits curtailed users legally to transfer their entitlements. Thus, the note proposes the institution of a white market for end users within the current regulatory framework of natural gas curtailment.
