Book Review:
Mark Tushnet, The Dialectics of Legal History, Reviewing
“Patterns of American Legal Thought” by G. Edward White, 57
Texas L. Rev. 1295 (1979).
Abstract:
Professor Tushnet states that Professor White’s collection of
previously published essays is merely a preliminary account on
the new turn of the dialectical spiral. He argues Professor
White’s essays lack textual analysis. Although White’s attention
to structures of thought is found by Tushnet to be admirable,
Tushnet concludes that White links these structures to society
by little more than juxtaposition. The source of White’s
inadequacies, Tushnet concludes, ultimately stems from his
persuasive liberalism that is revealed in his essays.
