Abstract:
As federal, state, and local governments pass statutes allowing
for collective bargaining agreements between them and their
employees, the use of arbitration clauses has also increased
correspondingly. When government employees are unable to come to
an agreement with their employer, public authorities have
increasingly sought to use binding arbitration as a means of
resolving bargaining impasses. This Article examines the extent
to which prearbitration and postarbitration judicial
intercession is currently available in the context of a public
labor dispute.
