Abstract:
The development of nuclear energy has created one of the
greatest dilemmas facing twentieth century governments, because
of the inherent conflict between energy needs and environmental
protection. This is apparent in the National Environmental
Policy Act (NEPA), which seeks to balance the competing
interests of resource development against environmental
degradation. This Note examines agency decisionmaking and the
scope of judicial review of agency action in the environmental
area. To do so, the author takes the specific issue of nuclear
waste management and disposal and follows it through the
administrative and judicial machinery.
