Abstract:
This Note argues that protecting individual activity does not
determine unionism and is consistent with the text and the
spirit of the NLRA. Part I briefly examines the history of legal
protections for individual workers and recent proposals to
provide additional relief. Part II shows that protection for
individual activity—when it relates the terms and conditions of
employment and can benefit other workers—furthers the general
policies of the NLRA. Part III musters support from cases and
legislative history to justify encouraging individual activity
under existing law.
