Abstract:
This Note examines the Natural Gas Policy Act of 1978 (NGPA) in its evolutionary context as a means of understanding the Act and its future interpretation. The author specifically examines the wellhead pricing provisions as representative of the legislative purposes and intended application of the Act. The Note concludes that Congress used statutory principles of incentive pricing of new gas, price controls on intrastate gas, and maintenance of price controls on old gas to protect consumers and create a market-based regulatory system.
