Abstract:
This Note focuses on seniority systems that have discriminated against employees on an illegal basis. It looks at the conflict between congressional and executive approaches to established seniority systems that contain the residue of past discrimination. It argues for a modification of the executive seniority policy in order to increase the viability of the program and achieve internal consistency to facilitate the elimination of employment discrimination.
