Abstract:
This Article investigates employment discrimination problems
that may emerge as employers develop and implement novel
risk-oriented hiring screenings. It begins by describing the
most common risk-oriented screens. It then evaluates the
economic incentives that lead employers to develop these screens
and factors that influence employers to deviate from pure
economic behavior in their hiring decisions. The article then
makes an argument for government intervention and examines
current statutory remedies and the inadequacies of existing
state and federal regulations.
