Abstract:
This Note examines the source and extent of the federal power to
deport, and explains the recognized constitutional limitations
on the exercise of that power. Furthermore, it discusses
theories that people use to resist deportation and analyzes the
weaknesses of those defenses. In addition, the Note advances a
theory of procedural due process that would prohibit the INS
from deporting aliens who lose their legal status due to the
Service’s own misconduct.
