Abstract:
In this Article, Professor Hyde explores several issues raised
by the NLRB’s holding in Firestone Steel Products Co. The case
was brought by United Auto Workers (UAW) against Firestone,
alleging that the company’s exclusion of the Union’s literature
violated Section 8(a) (1) of the National Labor Relations
(Wagner) Act. The Article analyses the distinction between
political activity and normal bargaining activity. Furthermore,
it examines the problems posed by government contractors.
Professor Hyde seeks to show that a number of vexing problems in
labor law disappear once one permits oneself to view labor
organization as a process of politics in addition to economics.
