Abstract:
In this article, the author responds to a comment by Professor Rand E. Rosenblatt on the author’s article on medical care which appeared in an earlier addition of the Texas Law Review. In the original article, the author argued that before-the-fact allocation decisions are not consistent with a market economy. The article further considered the role of government in a market system. In this answer to Professor Rosenblatt’s response, the article argues that the two agree in their doctrinal interpretation of the state of malpractice law, though there may be other fundamental differences.
