Abstract:
In this Note, the author argues that a cooperative federalism
approach is inappropriate for worker protection because “state
agencies involved do not carry out their congressionally
delegated duties, and because the cooperative federalism
structure itself leaves both the federal government and the
unprotected workers effectively unable to compel the states to
undertake their enforcement responsibilities.” The Note traces
the development of cooperative federalism and examines the
motivations of state agencies and the effectiveness of
mechanisms of federal coercion.
