Abstract:
In this article, the author examines the development of
antitrust law, focusing on the development of the law of
monopolization. Analysis is divided into three chronological
parts: early cases against trusts; cases during the World War II
era challenging dominant firms in mature industries; and cases
brought during the 1960s and the 1970s dealing with dominant
firms in technologically complex industries. By way of
illustration, the author discusses cases brought by competitors
against IBM. Throughout the article, the author focuses on
political, theoretical, and institutional factors influencing
the development of antitrust law and to critique this
development from both an institutional and a theoretical
perspective.
