Abstract:
This Note examines the definition of package as that term is used in the Carriage of Goods by Sea Act, which limits a cargo owner’s recovery for cargo damage, absent a declaration of value, to the lesser of the value of the goods or $500 per package. The Note examines the history of the Act’s “package” limitation and the premises underlying judicial attempts to adapt that limitation to the container era. Finally, the Note proposes an alternative “liability yardstick” approach to defining “package.”
