Note:
David L. Kern, Due Process in the Civil Nonsupport
Proceeding: The Right to Counsel and Alternatives to
Incarceration, 61 TEXAS L. REV. 291 (1982).
Abstract:
In this Note, Kern argues that the due process rights of child
support obligors are not properly observed by courts in
nonsupport proceedings. Although nonsupport proceedings are
civil, they may result in prison time for the non-paying parent.
Kern delineates the right to counsel doctrine and discusses its
utility in the context of nonsupport hearings for indigent child
support obligors.
