Abstract:
This note explores the recent scrutiny of an employer’s
traditional right to discharge an employee for any reason. The
author discusses the relatively new judicially-created
protections for at-will employees that protect against improper
dismissals, and highlights that purely arbitrary dismissals are
not covered. The note suggests that requiring dismissal review
procedures in which non-managerial employees take part would
produce a positive synergy: employees would gain not only
protection against arbitrary dismissal, but also a sense of
dignity and self-determination that likely would increase
productivity.
