Abstract:
In “Effective Schools and Federal and State Constitutions,” Professor Yudof responds to Professor Gershon Ratner’s article, “A New Legal Duty for Urban Public Schools.” Ratner’s article proposes that courts apply a legal duty to urban public schools to successfully teach basic skills to the vast majority of its students. Professor Yudof responds with excerpts from the unpublished opinions of Saxton v. Norden Independent School District. Yudof offers these excerpts in an attempt to enlighten the misguided on the issue of public education.
