Abstract:
These two books represent a significant
development in the movement to devise procedures fro corralling
the complex litigation monster. They reflect the experiences of
a judge on the one hand and of special masters on the other
grappling with the problems of complex cases. Judge William
Schwarzer draws on his experiences in trying complex cases,
offering both a theoretical framework and practical devices for
streamlining and speeding up the litigation process. Professors
Geoffrey Hazard and Paul Rice provide an illuminating case study
of the management techniques that worked for them as special
masters in the massive United States v. AT&T case. Their
co-author, Professor wayne Brazil, contributes his expertise
from research on civil discovery and dispute resolution under
American Bar Foundation sponsorship.
