Abstract:
Professor Albright reviews the doctrine of forum non conveniens
and its demise in Texas. Analyzing the current constitutional
law of in personam jurisdiction, especially the confusion over
general and specific jurisdiction, the author demonstrates a
trend toward elevating the forum non conveniens balancing of
competing factors to constitutional dimensions, concluding that
recent Texas Supreme Court opinions have badly distorted the
personal jurisdiction doctrine. The author argues that due
process should not turn on fine-tuned analyses of competing
interests in a particular forum.
