Abstract:
The enactment of Title VII of the 1964 Civil Rights Act has
resulted in an increased number of women entering the legal
profession. Under Title VII case law, discriminatory action by a
law firm constitutes a violation of federal employment law, even
if it is in pursuit of a client’s best interests. In this
Article, Kissinger considers the various ways in which gender
stereotypes can demean female attorneys in the courtroom and, as
a result, harm the interests of their clients and prompting
discriminatory action by a law firm to protect the client.
Furthermore, Kissinger examines whether female attorneys have a
professional duty to withdraw from representation when their
gender may potentially disadvantage their clients. Kissinger
proposes a solution to the professional dilemma faced by female
attorneys who are the victims of gender bias.
