Abstract:
Because each state bar association that has enacted or considered a prohibition on attorney-client sexual relations has relied upon its existing attorney disciplinary systems as the mechanism of enforcement, this Note will focus on the unique problems inherent in trying to enforce such a rule solely through a disciplinary system. Finding the existing disciplinary systems incapable of sufficiently enforcing bans on attorney-client sexual relationships, this Note proposes the use of an enforcement mechanism wholly outside the realm of the existing disciplinary schemes: the criminal justice system.
