Abstract:
“Pattern-based memory” theory is a newly developed conception of memory and the errors that interfere with the normal functioning of witness memory. In this Article, Tomlinson re-examines the underlying logic of the law of evidence in light of pattern-based memory, and argues that the new conception of memory mandates the repeal or modification of Federal Rule of Evidence 612.
