Abstract:
Through the lens of the United States peace-keeping mission in
Somalia, Turley’s Note addresses three fundamental questions
posed by nontraditional military deployment from the perspective
of the U.S. role in the international arena: Do the laws of
armed conflict apply? What difference does it make whether they
do? And finally, what changes, if any, are needed in
international law?
In answering those three questions, Turley considers the
following topics: the overall development of international laws
of armed conflict and their applicability to the traditional
waging of war, the evolution and expansion of nontraditional
deployments, the applicability of the laws of war to such
missions and the consequences of such applicability or the lack
thereof. In conclusion, Turley argues that new guidelines are
necessary to deal with the changing nature of international
deployments and offers some suggestions for reform.
