Abstract:
In “Federalizing Legal Ethics”, Professor Zacharias considers whether the United States Congress should adopt uniform federal rules to govern the conduct of lawyers throughout the United States. The author addresses the pragmatic considerations of adopting a uniform standard, including the need for federal intervention; Congress’ competence to enact professional regulation; and the practical impact a uniform set of rules would have on the legal profession. Zacharias presents possible approaches Congress might take in designing and implementing a uniform system, and suggests methods for unifying state codes in the event Congress does not establish a governing code of conduct.
