Abstract:
Ever
crowd-surfed at a concert and wondered what happens if you are
dropped? This Note
analyzes traditional assumption of risk and comparative
negligence principles, focusing heavily on spectator injuries at
sporting events, and applies them to the relatively novel,
modern concert venue. It
offers three solutions—logistical, legislative, and legal—to
address the growing problem of mosh-pit and crowd-crush injuries
and deaths. Ultimately,
this Note offers the legal alternative as the most promising
solution and suggests a judicial framework for evaluating modern
concert injury cases.
