Note:
Daniel
Riess, Federal Sovereign Immunity and Compensatory Contempt,
80 TEXAS L. REV. 1487 (2002).
Abstract:
When
federal sovereign immunity and the judicial contempt power
conflict with one another, federal courts have disagreed on
which doctrine should trump.
This Note resolves this dilemma after examining how each
doctrine promotes the separation of powers and exploring the
specific factual contexts in which this problem has arisen.
