The Review to host Continuing Legal Education

On April 10, 2014, the Review will be hosting a Continuing Legal Education Seminar at the University of Texas School of Law. Attendees will earn two hours of CLE credit. A description is below:

Mediation Strategies for Practicing Litigators: Professors Mark Kincaid ('83) and Tracy Walters McCormack ('86) will discuss effective use of mediation as part of attorneys' litigation practice. Professor Kincaid, a partner at George Brothers Kincaid and Horton, will draw on his experience in business and insurance litigation to offer practical advice on using mediation to pursue clients' cases. Professor McCormack, the Director of Advocacy at UT, will use her research into mandatory mediation to discuss the new roles of judges, mediators, and lawyers in today's mediation-focused legal landscape.

Motions to Dismiss Under New Texas Rule 91a: Practice, Procedure and Review. Effective March 1, 2013, a party may move to dismiss a cause of action on the grounds that it has no basis in fact or law under newly-adopted Rule 91a. Before the adoption of Rule 91a, Texas courts had long rejected attempts to transform special exceptions or motions for summary judgment into a practice akin to federal rule 12(b)(6) or otherwise allow a party to pursue a “motion to dismiss” absent authorization by statute or procedural rule. With the advent of Rule 91a, however, Texas now has a motion-to-dismiss procedure applicable to all categories of civil litigation other than family law and inmate suits. Motions to Dismiss analyzes the procedural and substantive aspects of filing and responding to Rule 91a motions and is designed to provide real-world, practical assistance to attorneys, trial judges and appellate courts.
