Tort Across Borders: The Art of Comparing Different Systems of Compensation.
This course will examine how one can study, understand, and compare different systems of tort compensation. The emphasis will be in discovering and describing a methodology which will provide transferable skills suitable to other branches of the law. It will demonstrate how different systems can be shown to converge in their solutions and how, through comparison, one can end up better understanding one's own law. Topics to be looked at may vary from year to year, but will probably include a discussion of such important issues as the border line of contract, and tort, compensation pure economic loss, wrongful life and wrongful death, the protection of human privacy and the controversial topic of using foreign law as a source of inspiration in contemporary constitutional jurisprudence. Graded: pass/fail.
