This course is restricted to upper division students only.
Description
The course deals with three issues that are of major concern to those who plan and to those who litigate or arbitrate interstate and international disputes. (1) Where can the parties litigate or arbitrate their disputes? (2) What law will the court or arbitration tribunal apply? (3) To what extent will other jurisdictions recognize and enforce the judgment or award? Much can be done at the planning and drafting stage to influence the answers. The materials place heavy emphasis on comparing U.S. and foreign responses to the issues.
