Students in this clinic mediate disputes between real people. Most of the cases handled by the Mediation Clinic are referred for mediation from small claims courts. In addition, the Clinic may accept cases from other courts and non- profit entities. Students interview the disputants, make arrangements for the mediation, prepare for and conduct mediations. Also, students may serve as mediators for litigation advocacy classes and for mediation competitions. A flexible schedule is essential for students in the Mediation Clinic because mediations occur outside class hours. Weekly class meetings examine the mediation process and mediation skills in depth, as well as ethical standards for mediators. Students also complete a class project focused on a particular aspect of mediation.
All students enrolled in the Mediation Clinic must have completed a mediation course or training program that complies with Texas Civil Practice and Remedies Code section 154.052(a), which requires a minimum of 40 classroom hours of training in dispute resolution techniques. Students who have completed the Law School's Mediation class, Law 381S, meet this statutory requirement. Any other course that meets the statutory requirement also satisfies the prerequisite. There are no other prerequisites. The Mediation Clinic is open to Law students as well as graduate students in other disciplines. This course is approved by the interdisciplinary Portfolio Program in Dispute Resolution as meeting the requirement for a course in the practical application of dispute resolution processes.
The Mediation Clinic carries four hours of credit, and it is offered in the fall and spring semesters. This course is offered on a pass/fail basis, and enrollment is limited.
