Description
This course will seek to provide an understanding of lawyer liability for professional activities and of techniques that can be used to avoid claims by providing quality legal services. The relationship between ethics and malpractice claims will be emphasized.
Students will consider a number of examples of legal malpractice claims not found in traditional case reports to foster an understanding the totality of challenges lawyers can face in practice.
Insurance issues will be discussed, including public policy issues such as whether insurance should be required and the national trend toward mandatory disclosure to clients of the existence of insurance.
