Description: This session explores the critical question of what it means for an oversight entity to be “independent.” Anne Owers, the head of the British Prison Inspectorate, begins with a presentation that examines the complexity of independence. Independence, she argues, is about ethos and culture more than it is about the structure of an organization, but also depends heavily on an oversight body’s role. Panelist Matthew Cate, who has responsibility for investigating and inspecting the California prison system, then examines what it means to have “backbone.” He offers suggestions for structural features that make independence more feasible, including the right of unfettered access to prisons. Cecilia Nordenfelt, the Ombudsman for the Swedish prison system, talks about the need for adequate financing of an oversight body and the need to maintain an appropriate distance between the monitor and the agency under review. Bob Gangi, who directs an advocacy organization with legislative authority to inspect and report on prison conditions in New York, argues that true independence requires independence from government entirely, and that independence also allows for the ability of the monitor to engage in follow-up advocacy efforts.
