CHAPTER 9 - PERSONNEL - CLASSIFIED

Sec. 9.91. Outside Employment Activities of Classified Staff

1. The University of Texas at Austin recognizes the personal and private rights of members of the classified staff to engage in outside employment; so long as that activity is compatible with the full and proper discharge of obligations to the University. Outside employment, whether remunerative or not, shall not conflict with or compromise these primary obligations to the University.

2. Outside employment must not create or result in conflict of interest or even the appearance of a conflict of interest, and it must not result in impairment of mental or physical capacity to perform the duties of University employment in a satisfactory manner. The department chairman, director or supervisor has the responsibility for determining whether or not outside employment has an adverse effect on an employee's performance of University duties. Should it be so determined, the employee will be requested to resign the outside employment voluntarily or the supervisor may take other action, including discharge, to see that the duties are performed properly.

3. Normally, classified staff members work defined hours and days and their outside employment will be at other times. Except as noted below, such employment should be reported to, and records kept by, the chairman, director or supervisor and no further approval is required.

4. Outside employment must conform to the Regents' Rules and Regulations (Part One, Chapter III, Section 13). Attention is drawn especially to the requirement that regular employment by other agencies of the State of Texas or the Federal government must be approved by the Board of Regents and information on compensation from such employment must be supplied to the Office of the President. Attention also is drawn to Presidential Policy Memorandum 7.205 relating to the payment of consulting fees.

5. In some instances, classified staff members are considered to be professional staff and are covered by Section 3.19 relating to consulting and outside employment for faculty and professional staff. Determination of which positions involve professional responsibilities will be made by the President.
