CHAPTER 10 - FIRE CODE
Title 1. General Provisions

Chapter 2. Administration

Sec. 2.001. Enforcement

(a) The ultimate enforcement of the provisions of this Code is vested with the following administrative officials:

(1) the Vice President for Business Affairs if the violation involves someone other than a faculty member;

(2) the Vice President for Academic Affairs and Research if the violation involves a faculty member.

(b) It is the duty of the Fire Marshal and members of the Safety Office to insure full compliance with the Fire Code.

(c) If a violation of the Code has occured, the Fire Marshal shall take the following steps:

(1) make a record of the violator and the specific provision of the Code violated;

(2) inform the violator of the Code provision he has violated;

(3) inform the appropriate Vice President if this is a subsequent violation of the same Code provision by the same violator.

(d) If a violation of the Code is occuring, it is the duty of the Fire Marshal to take the following steps:

(1) inform the violator what provision of the Code he or she is violating;

(2) request the violation cease immediately;

(3) inform the appropriate Vice President of the violation if:

(a) the violator does not cease his activity or,

(b) this violator ceases his activity, but this is a subsequent violation of the same provision by the same violator.

Sec. 2.002. Offices

(a) The Office of Fire Marshal shall be established for the purpose of fire prevention and of insuring full compliance with the Fire Code.

(b) The Safety Office shall be established to aid the Fire Marshal to carry out the general duties of his office. The office is to be composed of individuals with varied backgrounds and expertise and shall be used to supplement the expertise of the Fire Marshal.

Sec. 2.003. Duties

Duties of the Fire Marshal are as follows:

(a) The Fire Marshal and his assistants shall be responsible for inspection of all University buildings and property on a regular schedule or in response to notice of a possible Code violation; in carrying out this duty, the Fire Marshal shall have the authority to enter any building, structure, room, office, or laboratory.

(b) The Fire Marshal shall survey each building of the University and shall specify in a written report to the Vice President for Business Affairs suitable fire detecting devices or extinguishing appliances whenever such devices and appliances are needed. Such devices or appliances may consist of automatic fire detection and alarm systems, automatic sprinkler or water spray systems, standpipe and hose, fixed or portable fire extinguishers of a type suitable for the probable class of fire, or suitable asbestos blankets, manual or automatic covers, or carbon dioxide or other special fire extinguishing systems. In special hazardous areas, a combination of special alarm and extinguishing systems and appliances may be required. All extinguishers shall be of a correct approved type and size for the several classes of hazards according to the National Fire Protection ratings.

(c) The Fire Marshal shall inspect regularly all fire detection, fire alarm, and fire extinguishing devices in the University and shall request from the Vice President for Business Affairs maintenance or replacement if necessary.

(d) The Fire Marshal shall keep all fire protection equipment in good working condition and shall insure that extinguishers, hose and similar appliances are visible and convenient at all times.

(e) With respect to exitways the Fire Marshal shall:

(1) insure that required exit doorways, including those normally used for entrance, shall be plainly marked by approved exit signs, sufficiently illuminated when the floor area is occupied, to be readily distinguished;

(2) insure and require that directional signs shall be placed on walls or otherwise displayed in conspicuous locations to direct occupants to exit doorways, where the exit doorways are not visible from all locations in corridors, or hallways;

(3) insure that required stairways, hallways, and other means of egress, including exterior open spaces to or through which exitways lead, shall be kept adequately lighted at all times that the building served thereby is occupied;

(4) shall put on display in each building a plan for that particular building showing the capacity and location of exitways and of aisles leading thereto.

(f) Where conditions are such as to make smoking a hazard in any areas of warehouses, stores, classrooms, places of assembly, research laboratories, and in open spaces where combustible materials are stored or handled, the Fire Marshal shall post "No Smoking" signs in each building, structure, room or place in which smoking shall be prohibited; the Fire Marshal shall designate specific safe locations, if necessary, in any building, structure or place in which smoking may be permitted.

(g) The Fire Marshal shall recommend in writing to the Vice President for Business Affairs structured modifications of physical facilities or modification of building utilization when deemed necessary to minimize fire hazards.

(h) The Fire Marshal shall recommend in writing to the Vice President for Business Affairs amendments to the Fire Code in order to keep the Code current.

(i) The Fire Marshal shall report in writing to the Vice President for Business Affairs the following types of situations:

(1) dangerous or unlawful amounts of combustible or explosive or otherwise hazardous materials;

(2) hazardous conditions arising from defective or improperly installed equipment for handling or using combustible or explosive or otherwise hazardous materials;

(3) accumulation of rubbish, waste paper, boxes, shavings or highly flammable materials;

(4) accumulation of dust or waste material in air conditioning or ventilating systems or of grease in hitches or exhaust ducts;

(5) obstructions to or on fire escapes, stairs, passageways, doors or windows, which would interfere with the operations of the Fire Department or egress of occupants in case of fire or emergency;

(6) any building or other structure which:

(a) needs repair

(b) lacks adequate exit facilities

(c) lacks automatic or other fire alarm apparatus

(d) lacks fire extinguishing equipment.

(j) The Fire Marshal shall conduct annual gas leak tests at all assembly and institutional buildings;

(k) The Fire Marshal shall investigate all fires occurring on University property and shall request, if necessary, the aid of any or all state, county, city, or private personnel who are specialists in fire investigation in order to establish the cause;

(l) The Fire Marshal shall keep records of all fires and all information pertinent to the fire including but not limited to the origin of the fire, the extent of the damage, and recommendation for prevention of recurrence;

(m) The Fire Marshal shall conduct annual fire drill sessions in those buildings where he deems it necessary for the life safety of the occupants of the building;

(n) The Fire Marshal shall conduct a minimum of one (1) fire drill per semester in all student housing.
