CHAPTER 7. PERSONNEL - GENERAL

Subject: SECURITY-SENSITIVE POSITIONS

Pursuant to the provisions of Section 51.215, Texas Education Code H.B. 1550 passed by the 68th Texas Legislature), specific job requirements or physical location of some positions allocated to a classification within institutions of higher education may render the position security-sensitive.

Departments requesting that their positions be considered as security-sensitive must obtain approval from the Director, Office of Personnel Services and Employee Relations, by submitting written justification for such request.

If approval is granted by the Director, Office of Personnel Services and Employee Relations, the hiring departmental supervisor for a security-sensitive position shall require the applicant selected to complete the Security-Sensitive Disclosure form (PO-13). The position may only be offered to such applicant as a probationary appointment until the criminal history check has been completed by The University of Texas Police Department. Any applicant who refuses to provide the information requested will not be eligible for further consideration for that security-sensitive position.

In instances where a position is determined to be security-sensitive and where there is an incumbent employee who is probationary, refusal to complete the Security-Sensitive Disclosure form (PO-13) will be grounds for termination. Refusal by non-probationary employees to complete the Security-Sensitive Disclosure form (PO-13) will be grounds for administrative action which may include, among other remedies, transferring the employee to a comparably paid position which is not security-sensitive. In no event shall an incumbent employee, probationary or non-probationary, who refuses to complete a Security-Sensitive Disclosure form (PO-13) be retained in a position that has been designated and approved as security-sensitive.
